VIVAX does not disclose your personal data to the public, unless it receives your approval and only in connection with the supply of services through the International Site (for example, in order to allow VIVAX, upon your request, to post your photos and suggestions on the International Site as a testimonial. Should the above be necessary in order to supply services to you or to execute contracts for the purchase of products between you and VIVAX, the transfer of your personal data to any such countries will be carried out only after the execution of specific contracts between VIVAX and all parties involved, in accordance with applicable laws and regulations. What happens if you do not disclose your personal data to ViVAX The personal data we request you provide to VIVAX, including your e-mail address, your address, your credit/debit card numbers, bank account number and your telephone number, is necessary for the processing of your order for the purchase of products on the International Site, to supply other services provided on the International Site upon your request, or to carry out obligations arising out of applicable laws and regulations. Your refusal to provide certain personal data to VIVAX may prevent VIVAX from processing your order for the purchase of products sold on the International Site or from providing other services through the International Site. How do we collect your data on ViVAX.com When you are using the International Site, some personal data may be collected automatically through so-called “cookies”. If all of these conditions are satisfied, we will refund the value of the returned product(s), Sales Tax included, less any original shipping costs. You can send the return at your expense, with a courier of your choice. We will not issue any refunds for returns that do not satisfy all of the conditions indicated above; provided, however, that you will have the option to request within thirty (30) days of being notified that you are not entitled to a refund that your merchandise be shipped back to you, at your own cost, in the condition in which it was received by VIVAX. If you do not request the return of your merchandise within said thirty-day period, VIVAX will be entitled to dispose of such merchandise in its sole discretion. Refund Policy Returns using a Courier: Conditrions for the exchange of products In certain specific cases, duly specified in the Returned Goods Form, you are allowed to replace purchased products with other products, instead of being refunded the relative price. The request for an exchange is subject to the following conditions:
If all the above conditions are properly satisfied, once you have filled out and transmitted the Returned Goods Form containing your request for an exchange, VIVAX will process said request by sending you a relevant confirmation email. Deadlines and procedure for obtaining exchanges After receiving the products you intend to exchange and verifying that all the above-mentioned requirements have been fulfilled, VIVAX will verify the actual availability in its warehouses of the replacement products having the size and/or color you have selected. If the selected replacement product(s) is not available in its warehouses, VIVAX will not be able to accept your request for an exchange and will thus refund you the price of the product(s) originally purchased, in accordance with the procedures specified in VIVAX’s Return Policy. If the selected replacement product(s) is available in its warehouses, VIVAX will accept your request for an exchange and will therefore send you an email confirming the shipment of the replacement product(s). In this case, shipment will occur within thirty (30) working days of the date in which VIVAX becomes aware of your request for an exchange, once the company verifies that the latter fulfills all the above-mentioned requirements. The expenses for shipping the replacement products shall be borne by VIVAX, with a courier to be selected by VIVAX. If the price of the purchased product is lower or higher than the chosen replacement product, you will not be granted a refund nor will you be required to pay the relative price difference; keeping in mind that your replacement selection will be limited to the same model as originally purchased (size and/or color may vary). You will be contacted if your request for an exchange cannot be accepted due to your failure to fulfill the aforementioned conditions. Se per qualche ragione non sei soddisfatto del tuo ordine puoi esercitare il tuo diritto di recesso, senza alcuna penalità, entro dieci (10) giorni lavorativi dal giorno in cui hai ricevuto i prodotti acquistati su vivaxcases.com. I prodotti da rendere devono essere consegnati al corriere entro 10 giorni lavorativi dalla data del loro ricevimento. Se hai rispettato tutte le condizioni richieste, ViVAX ti rimborserà il prezzo dei prodotti acquistati, restando a tuo carico unicamente le spese del reso (vale a dire quelle per la restituzione a ViVAX dei prodotti acquistati) e la responsabilità in caso di smarrimento o danneggiamento dei prodotti durante il trasporto. Sarai contattato se il tuo reso non potrà essere accettato perché non conforme alle condizioni sopra riportate. In questo caso, potrai scegliere di riavere i prodotti acquistati a tue spese. Nel caso tu rifiutassi questa spedizione ViVAX si riserva il diritto di trattenere i prodotti e l’importo corrispondente per l’acquisto dei prodotti. II. Tempi e modalità di rimborso Dopo che ViVAX avrà ricevuto il tuo reso e controllato che tutti i requisiti siano stati rispettati, riceverai una e-mail di conferma di accettazione del reso. Qualunque sia la modalità di pagamento da te utilizzata (carta di credito/debito, pagamento in contanti alla consegna), il rimborso è attivato da ViVAX nel minore tempo possibile, e comunque entro trenta (30) giorni dalla data in cui è venuta a conoscenza dell’esercizio del tuo diritto di recesso, una volta verificato che il recesso sia avvenuto nel rispetto delle condizioni sopra riportate. Il tempo effettivo per il riaccredito o la restituzione delle somme da te pagate per l’acquisto dei prodotti dipende dalle modalità di pagamento utilizzate: III. Condizioni per il cambio dei prodotti In alcuni specifici casi, debitamente segnalati nel Modulo di Reso, avrai la possibilità di cambiare i prodotti acquistati con altri, anziché ottenere il rimborso del relativo prezzo. La richiesta di cambio avverrà nei limiti di seguito previsti:
Se tutte le condizioni sopra richiamate vengono correttamente rispettate, una volta compilato ed inviato il Modulo di Reso contenente la tua richiesta di cambio, ViVAX prenderà in carico la medesima richiesta di sostituzione inviandoti una e-mail di conferma a tal fine. IV. Tempi e modalità per ottenere il cambio Dopo che ViVAX avrà ricevuto i prodotti che intendi cambiare e controllato che tutti i requisiti su esposti siano stati rispettati, ViVAX verificherà l’effettiva disponibilità presso i propri magazzini dei prodotti nel colore che avrai selezionato. Nel caso in cui il prodotto o i prodotti selezionati per il cambio non risultino disponibili presso i propri magazzini, ViVAX non potrà accogliere la tua richiesta di cambio e procederà pertanto a rimborsarti il prezzo del prodotto o dei prodotti originariamente acquistati e non sostituibili, secondo le modalità previste nella sezione I e II della presente informativa. Nel caso in cui il prodotto o i prodotti selezionati per il cambio risultino disponibili, ViVAX potrà accogliere la tua richiesta di cambio e procederà pertanto ad inviarti un’e-mail di conferma dell’avvenuta spedizione dei prodotti sostitutivi. La spedizione avverrà in questo caso entro trenta (30) giorni dalla data in cui ViVAX sarà venuta a conoscenza della tua richiesta di cambio, una volta verificato che la stessa sia avvenuta nel rispetto delle condizioni sopra riportate. Le spese di spedizione dei prodotti sostitutivi saranno a carico di ViVAX, che ne sceglierà il relativo vettore. Laddove il prezzo del prodotto acquistato risulti inferiore o superiore al prezzo del prodotto selezionato per il cambio, non ti sarà riconosciuto alcun rimborso e/o aggravio per la differenza. Sarai contattato nel caso in cui la tua richiesta di cambio non possa essere accettata perché non conforme alle condizioni sopra riportate. In questo caso, potrai scegliere di riavere i prodotti che intendevi cambiare a tue spese. Nel caso tu rifiutassi questa spedizione, ViVAX si riserva il diritto di trattenere i prodotti e l’importo corrispondente per l’acquisto degli stessi.
